Failure to Register as a Sex Offender

Colorado Springs Sex Offender Registration Attorneys

Comprehensive Defense Strategies for Failing to Register as a Sex Offender in Colorado Springs

If you have been previously convicted of a sex crime, you are likely required to register as a sex offender. This means you must routinely provide your personal information to the local law enforcement agency to be publicly posted. Failing to register at any point when required can lead to additional criminal charges that carry serious penalties.

The best way to avoid having to worry about registering as a sex offender in the first place is to hire an experienced legal advocate to defend you when you have been accused of a sex crime. If you have already been convicted or accepted a plea that includes mandatory sex offender registration, however, it is in your best interest to comply with all reporting requirements. If you made a mistake or forgot to report your information and are now facing these criminal charges, turn to our Colorado Springs sex offender registration lawyers at The Gasper Law Group for dependable legal representation. We understand how to successfully navigate these cases and will fight to secure the best possible outcome.

Who Has to Register as a Sex Offender in Colorado?

Both adults and juveniles convicted of specific sexual offenses must register as sex offenders in Colorado. The length of time someone must register as a sex offender depends on the severity of the offense that led to their mandatory registration. Someone convicted of a misdemeanor sex crime must register for five years following the discharge of their sentence, for example.

When registering as a sex offender, an individual must report the following information to local law enforcement:

  • Current legal name as well as any former names
  • Current address and any additional addresses
  • Date of birth
  • Email address and any online usernames
  • A current photograph
  • Fingerprints

Registration must be completed within 5 days of release from incarceration. If a sex offender was not incarcerated, they have 5 days from the day they were notified of the mandatory registration requirement to provide the necessary information.

Sex offender registration is not a one-time act. Typically, a sex offender must provide updated information every year within 5 days of their date of birth (before or after). Individuals designated as “sexually violent predators” must register once every three months for the rest of their lives. These additional reporting requirements are what get many people into trouble.

A sex offender is also required to immediately report any of the following changes:

  • Any change in address
  • Any new residence
  • Any legal name change
  • Getting a job at a university, college, or vocational school
  • Enrolling in a university, college, or vocational school
  • Any change to online usernames

If you are required to register as a sex offender in Colorado and are confused about when you are required to contact your local law enforcement agency, we encourage you to reach out to The Gasper Law Group. Our Colorado Springs sex offender registration attorneys can help you understand your specific reporting requirements and help you avoid the possibility of facing additional criminal charges.

What Are the Consequences of Failing to Register as a Sex Offender in Colorado?

If you are required to register as a sex offender but fail to do so at any point, you will likely face additional criminal charges. The severity of these charges and the accompanying penalties will depend on the level of charge you were initially convicted of.

If you were convicted of a misdemeanor sex crime, failing to register is a class 1 misdemeanor. Punishments include up to 6 to 24 months of jail time and up to $5,000 in fines.

If you were convicted of a felony sex crime, failing to register becomes a class 6 felony. Punishments include 12 to 18 months of prison time and up to $100,000 in fines.

"I was absolutely floored with the knowledge and expertise that not only Caryn carries, but the firm as a whole."
I, unfortunately, was involved with two separate situations within a few years of each other, which left me in quite a bind both times. I was lucky enough to have Caryn assist me in both cases and was absolutely floored with the knowledge and expertise that not only she carries, but the firm as a whole. One of the best, if not the best lawyers I've ever come across. Extremely nice and very honest. I was able to resolve my situations with minimal impact and continue my life without fear of being held back.

"The professionalism, guidance, and candor I’ve received from each person in this law firm has been beyond reproach."

I’m not one to have an extensive experience with law firms or lawyers and court in general. However, the professionalism, guidance, and candor I’ve received from each person in this law firm have been beyond reproach. Anytime, I mean, anytime, I’ve had a question about my case and the way forward, I was met with a friendly and constructive conversation about my case. There was never a doubt in my mind, that I made the right choice when I selected this law firm to represent me. Caryn and Stacie have been a wonderful blessing to my life and my legal proceedings. If you are looking for a no-BS law firm that has a significant reputation in the Springs area, I absolutely recommend this one. Even though I hope to not have to deal with this again, fingers crossed and every lucky charm, I’d trust this law firm with my representation to handle the hard stuff and give me ease with court proceedings. Thank you all for what you do and have done for me, my family, and my career. Bless you all.

Defenses for Failing to Register as a Sex Offender in Colorado

We will carefully review your circumstances and walk you through the defense options available in your case. Our Colorado Springs sex offender registration lawyers always fight to secure the best possible result, no matter the scenario.

One common defense for failing to register is a lack of knowledge or understanding of the registration requirements. In some cases, individuals may not be fully aware of their duty to register, especially if they were not adequately informed by the court, parole officer, or other judicial personnel. We may be able to demonstrate you were unaware or not adequately informed of the registration requirements. Proving that the lack of compliance was an honest mistake or misunderstanding can often lead to more favorable outcomes.

Sex offenders may not always have the physical ability to keep their registration current. If we can prove you failed to register because you were incapacitated due to illness, you were unable to reach local law enforcement because of a natural disaster, or you were the victim of a crime, for example, we may be able to build a robust defense.

Some defense strategies may hinge on errors or inaccuracies within the legal process. For example, a mistake in court records or the authorities’ failure to correctly carry out their responsibilities could provide a basis for a defense.
