The role an attorney plays during the legal separation process is exactly the same as the process an attorney follows during divorce proceedings. Both parties must have their own counsel; an attorney cannot fairly represent both spouses in a separation agreement. Both types of processes also end with similar orders, and both people have to agree the process will end in separation rather than divorce. How does legal separation affect child custody and child support arrangements?
In a legal separation, child custody and child support arrangements are addressed similarly to how they would be in a divorce.
Here's how they are typically affected:
- Child Custody: During a legal separation, the court will determine custody arrangements based on the best interests of the child. This includes deciding on physical custody (where the child lives) and legal custody (decision-making authority regarding the child's upbringing).
- Child Support: The court will also establish child support obligations during a legal separation. This is calculated based on factors such as each parent's income, the amount of time the child spends with each parent, and the child's needs.
- Temporary Orders: Often, temporary orders are put in place during the legal separation process to address custody and support until a final agreement is reached.
- Modification: Both child custody and child support arrangements can be modified if there is a significant change in circumstances, such as a change in income, relocation, or changes in the child's needs.
