How the Divorce Process Works in Colorado Springs
Colorado is a no-fault state, so the only ground required to dissolve a marriage is alleging that it is irretrievably broken. There’s no requirement to prove misconduct by either spouse. Under Colorado Revised Statutes § 14-10-106, at least one spouse must have resided in Colorado for at least 91 days before the petition for dissolution is filed, and a minimum of 91 days must pass before the court can enter a final decree.

Property, Finances & Parental Rights in a Same-Sex Divorce
Two areas of a same-sex divorce often require closer attention than in a standard dissolution: financial questions tied to the marriage-recognition timeline, and parental-rights questions when legal parentage wasn’t formally established during the relationship.
Property Division & Spousal Maintenance
Colorado divides marital property under an equitable distribution standard, meaning the court divides assets fairly based on the circumstances, not necessarily equally. The marital estate generally includes property acquired from the date of marriage through the date the divorce petition is filed. For couples who built assets together before Colorado recognized their marriage, determining that start date can itself become a contested issue.
Colorado law refers to alimony as spousal maintenance. The amount is calculated using a formula based on each spouse’s income and the length of the marriage, though a judge may adjust the formula when the circumstances call for it. For couples whose relationship predated formal marriage recognition, the effective length of the marriage for maintenance purposes may require careful argument.
Parentage & Custody
Colorado law presumes that both spouses in a same-sex marriage are legal parents of a child born during the marriage under the Colorado Uniform Parentage Act (C.R.S. 19-4-105). That presumption provides a foundation, but it isn’t automatic protection in every situation. A non-biological parent who didn’t complete a second-parent adoption or secure a parentage order may face a more complicated path to parenting time and decision-making authority.
Colorado courts determine parenting time and decision-making responsibility based on the best interests of the child, applying the same standard regardless of whether the parents are of the same or different sexes. If there’s any question about legal parentage in your case, addressing it early is important.

No Fault DivorceThe only proof needed for divorce under Colorado law is that the marriage is “irretrievably broken.” No-fault divorce means that fault is not considered a factor in divorce.

Contested & Non-Contested DivorceDissolving a marriage is divided into two key considerations, which is contested vs. uncontested divorce. If a divorce occurs with both parties agreeing on all points (child custody, child support, division of assets, and spousal maintenance) then the divorce is considered an uncontested divorce. However, if any of these or other circumstances related to the marriage are in dispute, it becomes a contested divorce.
