Colorado Springs Multiple DUI Attorney

Defending Accused Drivers with Prior DUI Convictions in El Paso County, CO

At The Gasper Law Group, we understand how frightening and overwhelming it can be to get arrested for drunk driving. Whether it’s the first or subsequent DUI, drunk driving offenses can lead to serious life-altering repercussions for accused drivers, which is why it’s crucial to seek an experienced defense. Fortunately, our fierce multiple DUI defense attorneys have nearly 20 years of experience aggressively defending the rights of defendants in Colorado Springs and beyond.

With thousands of criminal cases handled, you can trust our lawyers to provide the strong representation you need to defend against a subsequent DUI offense. When your personal reputation and freedom are on the line, don’t throw away your future by failing to secure a strong defense. Our firm can work tirelessly to help you avoid the harsh penalties of multiple DUI convictions.

Multiple DUI cases are often more complex than first-time offenses because the prosecutor can rely on prior convictions to argue for tougher sentences and may have more leverage in plea negotiations. Having a multiple dui attorney who regularly appears in El Paso County and Teller County courts can make a difference in how evidence is challenged, how prior out-of-state DUIs are counted, and what alternatives to jail may be realistically available in your situation.

Multiple DUIs can lead to felony charges and severe penalties. Our experienced Colorado Springs multiple DUI defense attorneys can aggressively defend your rights. Call (719) 212-2448 to request a free consultation.

Can Felony DUI Charges Be Dismissed?

Yes. In some cases, it may be possible to get fourth or subsequent DUI charges dismissed. However, hiring an experienced multiple DUI defense lawyer is nonnegotiable to obtain a favorable outcome, as they can establish the strongest defense possible for your unique needs and fortify your claims with compelling evidence.

Some common defenses against multiple DUI convictions include:

  • Compromised chemical tests, such as BAC/breathalyzer results
  • Preexisting health conditions that resulted in an inaccurate BAC reading
  • Police misconduct, such as constitutional violations of the driver’s rights

In addition to these defenses, our team can dig into the history of your prior DUIs to determine whether any earlier convictions were based on flawed procedures or incomplete records, especially if they occurred in other Colorado counties or in different states. In some situations, challenging how those prior cases are used to enhance current charges in Colorado Springs District Court can narrow the issues, reduce potential penalties, and give you more options when deciding whether to proceed to trial or pursue a negotiated resolution with the prosecution.

I, unfortunately, was involved with two separate situations within a few years of each other, which left me in quite a bind both times. I was lucky enough to have Caryn assist me in both cases and was absolutely floored with the knowledge and expertise that not only she carries, but the firm as a whole. One of the best, if not the best lawyers I've ever come across. Extremely nice and very honest. I was able to resolve my situations with minimal impact and continue my life without fear of being held back.

Penalties for Multiple DUI Convictions in Colorado

If you were arrested for a second, third, or subsequent DUI offense, it’s imperative to seek aggressive representation from an experienced defense lawyer with an in-depth knowledge of criminal law. Your attorney can negotiate on your behalf to reduce or drop the charges against you, in addition to employing an effective legal strategy in your defense.

  • DUI Charges with Prior Convictions

DUI laws are stringent in Colorado, and the consequences of a conviction can quickly derail a person's life. Multiple DUI offenses can lead to significantly worse penalties if convicted, resulting in harsher sentencing that can substantially affect your life and liberties.

Because each subsequent DUI charge is punishable by increasingly severe penalties, securing a strong defense is crucial to avoid the life-changing consequences of a criminal conviction, from hefty fines to lengthy prison sentences. It's important to understand that fourth and subsequent DUIs are considered felonies, making it all the more urgent for accused drivers to consult with a multiple DUI defense attorney to build them the strongest defense possible.

Multiple DUIs are punishable by varying penalties depending on the nature of the offense and the quantity of prior convictions.

  • Second DUI Offenses

Second-time DUI offenders can face varying penalties depending on the nature of the defense. Second DUI offenses are typically charged as misdemeanor offenses, although defendants can face felony charges (such as if the DUI entailed serious bodily injury or vehicular manslaughter). Drivers can also face felony charges for second DUI offenses if their blood alcohol concentration (BAC) was 0.20% or higher.

It's worth noting that unlike first-time DUIs, which may not result in jail time, second DUI offenses carry a minimum of 10 days in jail. Under Colorado Revised Statutes (C.R.S.) § 42-4-1307(5), second DUIs are punishable by:

    • $500 to $1,500 in fines
    • 10 days to 1 year in jail
    • 48 to120 hours of public service
    • Up to 2 years of probation

Keep in mind that courts can use sentencing alternatives at their discretion, meaning that the penalties for second-time DUI offenders may vary depending on the unique circumstances. However, the court is typically prohibited from doing so if the second DUI occurred within 5 years of the first offense.

  • Third DUI Offenses

Third DUI offenses are generally charged as misdemeanors, although third-time offenders can face felony convictions if the DUI involved bodily harm or death to another. Even when third-time DUI offenders aren’t facing felony charges, this doesn’t mean that drivers can’t reap extremely harsh penalties.

Under C.R.S. § 42-4-1307(6), third DUI offenses are generally punishable by:

    • 60 days to 1 year in jail
    • $600 to $1,500 in fines
    • 2 to 4 years of probation
    • 48 to 120 hours of community service
    • Up to 2 years of driver’s license revocation

Additionally, third-time DUI offenders may also be sentenced to 90 days of continuous alcohol monitoring, a program that often entails additional financial burdens and requirements. It's essential to seek representation from a skilled defense lawyer who can effectively negotiate the terms of your sentence and fight to secure a favorable outcome.

  • Fourth & Subsequent DUI Offenses

Unlike first, second, and third DUI offenses, fourth and subsequent DUIs are considered Class 4 felonies under Colorado law. Facingcriminal charges for a fourth or subsequent DUI with prior charges on your record can result in extremely harsh penalties. A felony DUI conviction is punishable by:

    • 2 to 6 years in prison (minimum of 90 days in jail)
    • $2,000 to $500,000 in fines
    • Installation of an ignition interlock device
    • 90 days of continuous alcohol monitoring
    • Up to 2 years of driver’s license suspension
