Criminal Solicitation Under C.R.S. § 18-2-301

This statute applies when a person commands, induces, or otherwise attempts to persuade another to commit a felony, with intent to promote or facilitate that crime, under circumstances strongly corroborative of that intent. The penalty is one class of crime less serious than the underlying felony solicited. If the underlying offense is a level 1 drug felony, the solicitation charge becomes a level 2 drug felony, which can be punishable by up to 8 years in prison.

Soliciting for Prostitution Under C.R.S. § 18-7-202

Under current Colorado law, soliciting for prostitution is a petty offense, carrying up to 10 days in jail and a fine of up to $300, plus a possible additional fine of up to $5,000. The law in this area has changed significantly over recent years, and the charge you face will be governed by the statute as it stands at the time of the alleged offense.

Soliciting for Child Prostitution Under C.R.S. § 18-7-402

This is a Class 3 felony, with penalties of 4 to 12 years in prison and fines ranging from $3,000 to $750,000. Charges involving minors can also trigger mandatory sex offender registration. Critically, attempting, conspiring, or soliciting to commit a class 2, 3, or 4 felony sex offense may be subject to Colorado’s indeterminate sentencing provisions under C.R.S. § 18-1.3-1004, which can mean supervision extending for life.
